אפליקציית שכר משמרות (Shift Salary) · בתוקף מ-27 באוגוסט 2026

תקנון זה מסדיר את השימוש באפליקציית שכר משמרות, המופעלת על ידי בן באשא ("אנחנו"). התקנת האפליקציה או שימוש בה מהווים הסכמה לתקנון. יצירת קשר: shiftsalary@benbasha.com.

1. מה האפליקציה

שכר משמרות היא שעון נוכחות אישי ומעקב שכר לעובדי משמרות. היא רושמת את המשמרות שלכם, עוקבת אחר כמה מקומות עבודה, ומציגה אומדן של השכר ברוטו. היא פועלת באחד משני מצבים, שאתם בוחרים ויכולים להחליף בכל עת:

• מצב ישראל. המשמרות מתומחרות לפי כללים כלליים בישראל ולפי ההגדרות שהזנתם: שעות נוספות יומיות ושבועיות, תעריפי שעות שבת וחג, סכומי נסיעות שהגדרתם, וטיפים. Pro במצב הזה מוסיף אומדן שכר נטו (מס הכנסה עם נקודות זיכוי, ביטוח לאומי, מס בריאות, פנסיה) עם פירוט של כל סכום, ובנוסף סטטיסטיקות וייצוא ל-CSV / אקסל.
• מצב עולמי. המשמרות מתומחרות לפי הכללים שאתם מגדירים: מטבע התצוגה מתוך רשימת 24 המטבעות הנתמכים באפליקציה, שעות נוספות שבועיות, שעות נוספות יומיות עם מדרגה שנייה אופציונלית, ימי המנוחה שלכם ותוספת אופציונלית ליום מנוחה. אין מנוע שכר נטו במצב העולמי, ולא מוחלים בו תעריפים סטטוטוריים של שום מדינה. Pro במצב הזה הוא סטטיסטיקות וגרפים, וייצוא ל-CSV / אקסל.

כל מה שהאפליקציה מציגה, בשני המצבים, הוא אומדן לשימושכם האישי (ראו סעיף 3).

2. רישיון שימוש

אנחנו מעניקים לכם רישיון אישי, לא בלעדי ולא ניתן להעברה, להשתמש באפליקציה במכשירים שבבעלותכם, לשימושכם. אסור להעתיק, לשנות, להפיץ, למכור, להשכיר או לבצע הנדסה לאחור של האפליקציה או לחלץ את קוד המקור שלה, אלא במידה שהדין מתיר זאת על אף תנאים אלה.

3. הערכה בלבד — לא תלוש, לא ייעוץ מס, משפטי או פיננסי

זהו החלק החשוב ביותר בתקנון:

• הסכומים ברוטו ונטו שהאפליקציה מציגה הם הערכה לשימושכם האישי. הם אינם תלוש שכר רשמי, ואינם ייעוץ שכר, מס, חשבונאי, משפטי או פיננסי.
• השכר בפועל שלכם נקבע אך ורק על ידי המעסיק, התלוש הרשמי, והרשויות הרלוונטיות בישראל (כולל רשות המסים והמוסד לביטוח לאומי). תעריפים, מדרגות, נקודות זיכוי, שכר מינימום וכללים משתנים ועשויים להיות שונים מהמצב, החוזה או ההסכם הענפי הספציפיים שלכם.
• תמיד יש לוודא מול התלוש הרשמי ומול הרשויות. אין להסתמך על המספרים באפליקציה לצורך מחלוקת, תביעה או כל החלטה פיננסית או משפטית.
• אנחנו לא קשורים, והאפליקציה אינה מטעם או מאושרת על ידי רשות המסים, המוסד לביטוח לאומי, משרד העבודה או כל גוף ממשלתי אחר.

4. הליבה החינמית הקבועה, ו-Pro

4.1 הליבה החינמית הקבועה

לאפליקציה יש ליבה חינמית קבועה: שעון החתמה וחישוב ברוטו שעובדים במלואם ואינם עולים דבר, בלי מנוי, בלי תקופת ניסיון ובלי רכישה מכל סוג. ההגבלה היא בכמות, לא בזמן ולא ביכולות: עד 3 משמרות בשבוע, כלל מקומות העבודה יחד.

בתוך המכסה השבועית הזו, הליבה החינמית כוללת:

• שעון ההחתמה (החתמת כניסה ויציאה ורישום המשמרת שנוצר ממנה);
• הפסקות, משמרות מפוצלות, והוספה ועריכה ידנית של משמרות;
• תזכורות מיקום בהגעה למקום עבודה וביציאה ממנו;
• מונה השכר החי במהלך המשמרת;
• חישוב השכר ברוטו: במצב ישראל לפי כללים כלליים בישראל ולפי ההגדרות שהזנתם, לרבות שעות נוספות יומיות ושבועיות ותעריפי שעות שבת וחג; במצב העולמי לפי המטבע, כללי השעות הנוספות, ימי המנוחה ותוספת יום המנוחה שאתם מגדירים בעצמכם;
• כמה מקומות עבודה, לכל אחד תעריף משלו;
• סיכומים חודשיים של שעות ושכר ברוטו, לכל מקום עבודה.

איך המכסה השבועית עובדת:

• שבוע נספר מיום ראשון עד שבת, לפי לוח השנה של המצב שבחרתם (שעון ישראל במצב ישראל, אזור הזמן של המכשיר במצב העולמי). המכסה מתאפסת עם תחילת השבוע הבא, ואינה חלון נע של שבעה ימים.
• כל רישום משמרת נספר כאחת, בכל מקום עבודה שהוא ובכל דרך שנוצר: בהחתמה או בהוספה ידנית. יום שנרשם כשתי משמרות נפרדות מנצל שתיים מתוך השלוש.
• ההגבלה חלה רק על פתיחה או הוספה של משמרת. החתמת יציאה ממשמרת שכבר נפתחה לעולם אינה נחסמת, וגם לא עריכה או מחיקה של משמרת כלשהי, ולא צפייה בנתון שהאפליקציה כבר חישבה.
• Pro מסיר את המגבלה השבועית לחלוטין (סעיף 4.2).

למה אנחנו מתחייבים, כל עוד האפליקציה זמינה:

• הליבה החינמית שלמעלה תישאר ללא תשלום, והמכסה השבועית לא תרד לעולם מתחת ל-3 משמרות בשבוע;
• לא נעביר יכולת מהליבה החינמית אל Pro או אל מאחורי תשלום אחר כלשהו, עבור משמרות שבתוך המכסה;
• Pro יישאר רכישה חד-פעמית ולא יהפוך למנוי או לחיוב חוזר.

התחייבות זו מחייבת אותנו ומהווה תנאי בהסכם זה.

4.2 Pro

• Pro הוא רכישה חד-פעמית אחת, מוצר אחד שמכסה את שני המצבים. הוא מסיר את מגבלת 3 המשמרות בשבוע, כך שאפשר להחתים ולהוסיף משמרות בלי הגבלה. במצב ישראל הוא פותח בנוסף את אומדן השכר נטו, את פירוט החישוב, את הסטטיסטיקות והגרפים ואת הייצוא ל-CSV / אקסל; במצב העולמי, שבו אין מנוע שכר נטו, הוא פותח את הסטטיסטיקות והגרפים ואת הייצוא ל-CSV / אקסל. אין מנוי ואין תקופת ניסיון.
• מכלול היכולות של Pro עשוי להשתנות: אנחנו רשאים להוסיף יכולות ל-Pro, וכן לשנות או להסיר יכולת של Pro (ראו סעיף 10). יכולת חדשה שנוסיף תשויך ל-Pro או לליבה החינמית לפי שיקול דעתנו, אך דבר מהמנוי בסעיף 4.1 לא יוצא ממנה, והמכסה השבועית שבסעיף 4.1 לא תצומצם.

5. תנאי הרכישה

בהתאם לגילוי המוצג באפליקציה לפני הרכישה:

• Pro נרכש פעם אחת במחיר המוצג באפליקציה. הרכישה אינה מתחדשת, אין מה לבטל, ולא תחויבו שוב.
• החיוב מתבצע כולו על ידי ה-App Store של אפל או Google Play בהתאם לתנאיהם. החזרים כספיים מטופלים על ידי החנות לפי מדיניות ההחזרים שלה; אין באפשרותנו לבצע החזרים ישירות. אם החנות מבצעת החזר, ייתכן ש-Pro יינעל מחדש.
• השתמשו ב"שחזור רכישות" כדי לפתוח את Pro ללא תשלום נוסף בכל מכשיר המחובר לאותו חשבון חנות שממנו נרכש.

6. הנתונים שלכם

נתוני המשמרות, השכר ומקומות העבודה נשארים על המכשיר שלכם ובתוך הגיבוי שאתם עצמכם עושים למכשיר (iCloud או Google); אין חשבון ואין סנכרון לענן אלינו, ואנחנו לעולם לא מקבלים אותם. כדי לשפר את האפליקציה אנחנו אוספים נתוני שימוש אנונימיים דרך Mixpanel ודיווחי קריסה אנונימיים דרך Firebase Crashlytics. שניהם פעילים תמיד ואין להם מתג באפליקציה, ומחיקת האפליקציה עוצרת את האיסוף. מה נאסף, מה לעולם לא נאסף וכמה זמן הוא נשמר מתוארים במדיניות הפרטיות בכתובת shiftsalary.benbasha.com/privacy. השימוש באפליקציה מהווה הסכמה לעיבוד כמתואר שם. מחיקת האפליקציה מסירה את הנתונים מהמכשיר; עותקים שנמצאים בגיבוי שלכם נשארים בשליטתכם, ונתוני שימוש או קריסות שכבר נשלחו נשמרים כמתואר במדיניות הפרטיות.

7. שימוש הוגן

אתם מתחייבים שלא לעשות שימוש לרעה באפליקציה — ובכלל זה לא לנסות לעקוף את מנגנון ה-Pro או את אימות הרכישה, לא לגרד (scrape) או לארוז מחדש את התוכן שלה, ולא להשתמש בה בדרך בלתי חוקית.

8. הסרת אחריות

האפליקציה מסופקת "כפי שהיא" (AS IS) ובכפוף לזמינותה, ללא אחריות מכל סוג, מפורשת או משתמעת — לרבות בנוגע לדיוק חישובי השכר, לשלמות, להתאמה למטרה מסוימת או לזמינות רציפה.

9. הגבלת אחריות

במידה המרבית המותרת בדין, לא נהיה אחראים לנזקים עקיפים, נלווים או תוצאתיים הנובעים מהשימוש באפליקציה — לרבות כל הסתמכות על הערכות השכר, כל מחלוקת שכר, או אובדן נתונים השמורים מקומית. סך אחריותנו לכל תביעה מוגבל לסכום ששילמתם עבור Pro (או אפס אם אתם משתמשים בגרסה החינמית).

10. שינויים באפליקציה או בתקנון

אנחנו רשאים לעדכן, לשנות או להפסיק את האפליקציה או כל יכולת בה בכל עת, למעט זאת שכל עוד האפליקציה זמינה לא נתנה יכולת מהליבה החינמית הקבועה (סעיף 4.1) בתשלום, לא נצמצם את המכסה השבועית החינמית מתחת ל-3 משמרות בשבוע, ולא נהפוך את Pro למנוי. אם התקנון ישתנה באופן מהותי, הגרסה המעודכנת תפורסם בכתובת shiftsalary.benbasha.com/terms עם תאריך תוקף חדש; המשך שימוש לאחר שינוי מהווה הסכמה לתקנון המעודכן.

11. סיום

אפשר להפסיק להשתמש באפליקציה בכל עת על ידי מחיקתה. אנחנו רשאים להשעות את הרישיון של מי שמפר תקנון זה הפרה מהותית.

12. דין וסמכות שיפוט

על תקנון זה חלים דיני מדינת ישראל, ולבתי המשפט המוסמכים בישראל סמכות שיפוט בלעדית בכל מחלוקת הנובעת ממנו.

These terms govern your use of the שכר משמרות (Shift Salary) mobile app, operated by Ben Basha ("we"). By installing or using the app you accept them. Contact: shiftsalary@benbasha.com.

1. What the app is

Shift Salary is a personal punch clock and pay tracker for shift workers. It records your shifts, tracks multiple workplaces, and shows an estimate of your gross pay. It runs in one of two modes, which you choose and can change at any time:

• Israel mode. Shifts are priced by general Israeli rules plus the settings you enter: daily and weekly overtime, Shabbat and holiday hour rates, travel amounts you configure, and tips. Pro in this mode adds an estimated net pay (income tax with credit points, Bituach Leumi / National Insurance, health insurance, pension) with a breakdown of every figure, plus statistics and CSV / Excel export.
• Global mode. Shifts are priced by the rules you configure — your display currency from the app's supported list of 24 currencies, weekly overtime, optional two-tier daily overtime, your own rest days and an optional rest premium. There is no net-pay engine in global mode, and no country's statutory rates are applied. Pro in this mode is statistics and charts plus CSV / Excel export.

Everything the app shows in either mode is an estimate for your personal reference (see section 3).

2. License to use

We grant you a personal, non-exclusive, non-transferable license to use the app on devices you own, for your own use. You may not copy, modify, distribute, sell, rent, or reverse-engineer the app or extract its source code, except where the law allows it despite these terms.

3. Estimates only — not payroll, tax, legal, or financial advice

This is the most important part of these terms:

• The gross and net figures the app shows are estimates for your personal reference. They are not an official payslip, and they are not payroll, tax, accounting, legal, or financial advice.
• Your actual pay is determined solely by your employer, your official payslip, and the relevant Israeli authorities (including the Israel Tax Authority and the National Insurance Institute / Bituach Leumi). Rates, brackets, credit points, minimum wage, and rules change and may differ from your specific situation, contract, or sector agreement.
• Always verify against your official payslip and the authorities. Do not rely on the app's numbers for a dispute, a claim, or any financial or legal decision.
• We are not affiliated with, and the app is not endorsed by, the Israel Tax Authority, the National Insurance Institute, the Ministry of Labor, or any other government body.

4. The permanent free core, and Pro

4.1 The permanent free core

The app has a permanent free core: a fully working punch clock and gross-pay calculation that costs nothing, with no subscription, no trial period, and no purchase of any kind. It is limited by volume, not by time and not by feature — up to 3 shifts per week, all workplaces counted together.

Within that weekly allowance, the free core is:

• the punch clock (clock in and clock out, and the shift record it creates);
• breaks, split shifts, and manual entry and editing of shifts;
• location reminders for arriving at and leaving a workplace;
• the live gross earnings counter during a shift;
• the gross-pay calculation — in Israel mode based on general Israeli rules and the settings you enter, including daily and weekly overtime and Shabbat / holiday hour rates; in global mode based on the currency, overtime rules, rest days and rest premium you configure yourself;
• multiple workplaces, each with its own rate;
• monthly totals of hours and gross pay, per workplace.

How the weekly allowance works:

• A week runs Sunday to Saturday, on the calendar your mode uses (Israel time in Israel mode, your device's time zone otherwise). The allowance resets when that week does; it is not a rolling seven days.
• Each shift record counts as one, whichever workplace it belongs to and however it was created — punched in, or added by hand. A day you record as two separate shifts therefore uses two of the three.
• The limit applies only to starting or adding a shift. Clocking out of a shift you have already started is never blocked, and neither is editing or deleting any shift, or seeing any figure the app has already calculated.
• Pro removes the weekly limit entirely (section 4.2).

What we undertake, while the app remains available:

• the free core above will remain free of charge, and the weekly allowance will never be reduced below 3 shifts per week;
• we will not move a feature out of the free core into Pro, or behind any other charge, for shifts within that allowance;
• Pro will remain a one-time purchase and will not become a subscription or a recurring charge.

This undertaking is binding on us and is a term of this agreement.

4.2 Pro

• Pro is a single one-time purchase, one product covering both modes. It removes the 3-shifts-per-week limit, so you can punch in and add shifts without any cap. In Israel mode it also unlocks estimated net pay, the calculation breakdown, statistics and charts, and CSV / Excel export; in global mode, where there is no net-pay engine, it unlocks statistics and charts and CSV / Excel export. There is no subscription and no free trial.
• Pro's own feature set may change: we may add features to Pro, and we may change or remove a Pro feature (see section 10). Any feature we add is added to Pro or to the free core at our discretion, but nothing already listed in section 4.1 may be moved out of it, and the weekly allowance in section 4.1 may not be reduced.

5. Purchase terms

Consistent with the disclosure shown in the app before purchase:

• Pro is bought once at the price shown in the app. It does not renew, there is nothing to cancel, and you are never charged again.
• Billing is handled entirely by Apple's App Store or Google Play under their terms. Refunds are handled by the store under its refund policy; we cannot issue refunds directly. If the store refunds your purchase, Pro may be locked again.
• Use "Restore purchases" to unlock Pro, free of charge, on any device signed into the same store account you bought it with.

6. Your data

Your shift, pay, and workplace data stays on your device and inside your own device backup (iCloud or Google); there is no account and no cloud sync to us, and we never receive any of it. To improve the app we collect anonymous usage analytics through Mixpanel and anonymous crash reports through Firebase Crashlytics. Both are always on with no switch in the app, and deleting the app stops the collection. What is collected, what is never collected, and how long it is kept are described in the Privacy Policy at shiftsalary.benbasha.com/privacy. By using the app you agree to that processing as described there. Deleting the app removes your data from the device; copies inside your own OS backup are under your control, and analytics or crash data already sent is retained as the Privacy Policy describes.

7. Acceptable use

You agree not to misuse the app — including attempting to bypass the Pro paywall or purchase verification, scraping or repackaging the app's content, or using the app in any unlawful way.

8. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, express or implied — including accuracy of any pay calculation, completeness, fitness for a particular purpose, or uninterrupted availability.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from use of the app — including any reliance on its pay estimates, any pay dispute, or loss of locally stored data. Our total liability for any claim is limited to the amount you paid for Pro (or zero if you use the free version).

10. Changes to the app or these terms

We may update, change, or discontinue the app or any feature at any time, except that, while the app remains available, we may not make a permanent free core feature (section 4.1) conditional on payment, reduce the free weekly allowance below 3 shifts per week, or turn Pro into a subscription. If these terms change materially, the updated version will be posted at shiftsalary.benbasha.com/terms with a new effective date; continued use after a change means you accept the updated terms.

11. Termination

You may stop using the app at any time by deleting it. We may suspend the license of anyone who materially breaches these terms.

12. Governing law

These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction over any dispute arising from them.
